Pre-election dispute: Court strikes out Amaechi’s suit against Atiku

The Federal High Court in Abuja on Friday struck out a pre-election dispute suit filed by the former governor of Rivers, Rotimi Amaechi, against former vice president Atiku Abubakar.
The News Agency of Nigeria (NAN) reports that Amaechi had filed the suit challenging the emergence of Abubakar as the presidential candidate of the African Democratic Congress (ADC).
Jutsice Joyce Abdulmalik, in a ruling, struck out the suit after the former governor’s lawyer, Jibrin Okutepa, SAN, moved a motion for withdrawal.
Okutepa informed the court that an application for the discontinuance of the case had already been filed after parties had settled their differences.
The senior lawyer prayed the court to strike out the case.
After listening to the counsel, Justice Abdulmalik made an order striking out the suit.
Amaechi, also a former minister of transport in the suit, prayed the court for an order setting aside the presidential primary election of May 25 that produced Abubakar as ADC candidate.
Amaechi, in the fresh suit, said the election was conducted in breach of Section 77(5) and (6) of the Electoral Act, 2026; the ADC’s Constitution, 2026; and Sections 2, 2.1 and 2.2 of ADC’s Guidelines for the conduct of primary elections for the nomination of candidates for the 2027 general elections.
He sought an order restraining Abubakar from parading himself or presenting himself for election as the presidential candidate of ADC at the 2027 general elections on the premise that he (Amaechi) won the poll held on May 25.
He equally sought an order restraining the Independent National Electoral Commission (NAN) from recognising Abubakar as the presidential candidate of ADC.
He sought an order mandating the party to conduct a fresh presidential primary election which must comply with the Electoral Act, 2006; Article 38.4 of the ADC’s Constitution; and the party’s guidelines for the conduct of the primary poll within 14 days from the date of the judgement.
The suit was filed by Amaechi’s lead counsel, Mr Okutepa.
In the originating summons marked FHC/ABJ/CS/1215/2026, the former minister sued Abubakar, ADC and INEC as defendants.
In the affidavit in support of the suit, deposed to by Amaechi himself, the former governor said he was a duly registered member of ADC at Ward 8, Ubima, Ikwerre Local Government Area of Rivers.
He said he is also a registered voter with the right to vote and be voted for at the general elections.
He described himself as “a graduate of English language from the University of Port Harcourt and also a legal practitioner.”
Amaechi said he purchased the party’s nomination form for the presidential primary election and was duly issued the form, screened alongside the other aspirants, and was cleared.
He said he duly participated in the party’s primary and appointed agents and coordinators to represent him and oversee the conduct for him at the national, state and ward levels across the country.
He said on May 27, ADC published the purported final result.
“The said result shows that Alhaji Atiku Abubakar won the election as he purportedly scored a total of 1,846,370 votes, while I purportedly scored a total of 504,177 votes to come a distant second, and Mohammed Hayatu-Deen purportedly scored a total of 177,120 votes to come third.”
The plaintiff alleged that the entire process of the election was done in breach and contravention of the Electoral Act, 2026; the ADC’s Constitution, 2026; and the guidelines for the conduct of primary elections for the nomination of candidates for the 2027 general elections as published by the party.
He said he knows that each political party was expected to submit such a membership register to INEC not later than 21 days before the date fixed for the party primaries, congresses and conventions.
He, however, averred that ADC did not use any membership register for the presidential primary election of the party held on May 25.
Amaechi said, instead, the party relied on the procedure set out in Section 10.8(6) of its guidelines.
He said he was aware that ADC did not apply to INEC to obtain a certified true copy of its membership register across the various states and electoral wards of Nigeria for use for accreditation during the said election.
He said he was present and monitored the election at various electoral wards that make up his local government.
He said even the final declaration of the result form made on May 27 was totally unsigned, with no column for signatures and names of the election committee members who authored them.
Besides, he said the names and signatures of his agent(s) were not on the form, “and the document is without a date.”
He said he wrote a letter to the National Organising Secretary (NOS) of the ADC, requesting certified true copies of the membership registered and used by the party for the accreditation of voters during the poll.
He said he received a response from the NOS that the membership registered was not used for the election.
Against this development, he said he wrote a petition to the presidential appeal committee of the party pursuant to Section 11 of the guidelines for the conduct of the election.
He said he was invited by the committee, and he adopted the petition and also submitted his written submission of facts in further support of the same.
He said when there was no response from the appeal committee, he wrote a letter to the national chairman of the party, Sen. David Mark, drawing his attention to the failure of the appeal committee to communicate its decision to me.
“Following the failure of the national chairman of the 2nd defendant (ADC) to address the concerns I raised regarding the said presidential primary election despite my letters and complaints, I proceeded to institute this suit,” he said. (NAN)

Kwankwaso opposes Tinubu’s Muslim-Muslim ticket
The vice-presidential candidate of the Nigeria Democratic Congress (NDC), Senator Rabiu Musa Kwankwaso, has defended himself against allegations of extremism, renewed his opposition to a Muslim-Muslim presidential ticket, and expressed confidence that the NDC ticket of Peter Obi and himself will win the 2027 presidential election.
Speaking on Channels Television’s Politics Today on Monday, Kwankwaso said Nigerians, particularly young people, are seeking leaders who can improve their living conditions rather than politicians focused on ethnic or religious sentiments.
“People are tired of the situation they are in now. They want something new, something that can help their lives, something that can improve the security and welfare of the people of this country,” he said.
He argued that critics of the NDC alliance are disconnected from the realities facing northern Nigeria.
“Those who are going against that ticket are not even conversant; they are not in touch with realities in northern Nigeria Today,” he said.
When asked about a proposed US bill that reportedly named him alongside others over allegations of religious persecution and communal violence, Kwankwaso dismissed the claims and said, “Let me start from the issue of assets. I have no asset anywhere outside Nigeria, so there is nothing to freeze.”
He described the allegations as politically motivated, saying, “Everybody has enemies. People decided to send my name here and there. But realities have now come out, and that issue is gone. It is no longer an issue.”
When asked whether he believed his name had been cleared, he responded: “I believe so.”
On the Muslim-Muslim ticket, Kwankwaso said he expects religion to remain an important issue in the 2027 elections, criticising President Bola Tinubu for again presenting a Muslim-Muslim ticket.
“I’m even surprised that the President again is presenting the same type of ticket,” he said.
According to him, President Tinubu has traditionally balanced political appointments and should do the same with his presidential ticket.
“I believe he still has time from now to the time of substitution to have a balanced ticket,” he said.
Although he acknowledged that there is nothing inherently wrong with a Muslim-Muslim or Christian-Christian ticket, he argued that Nigeria’s diversity makes religious balance preferable.
Reflecting on his own choice of running mate in the 2023 election, he said, “When I was looking for somebody to run with me, I got an archbishop so that we can go together and everybody will have a sense of belonging.”
Kwankwaso cited the 1993 SDP presidential ticket of MKO Abiola and Babagana Kingibe as an example where religion did not dominate political discourse, noting that “at that time, people were talking of competence, popularity and many other positive things.”
Addressing concerns that ongoing legal challenges involving the NDC could affect its participation in the 2027 elections, Kwankwaso said he was not worried.
He expressed confidence that the courts would not prevent the party from contesting.
“I don’t think any respected judge will be in a hurry to say NDC should not participate in the 2027 election,” he said.

2027 presidency: Our supporters are not people looking for food, money on election day – Kwankwaso
The vice presidential candidate of the Nigerian Democratic Congress, NDC, for the 2027 general elections, Engr Rabiu Kwankwaso, has said that supporters of the party are people looking for what to eat.
Appearing on Channels Television on Monday, the former Kano State governor said the NDC supporters are people who are bent on ensuring that there is change in the leadership of the country.
Kwankwaso and Peter Obi are the flag-bearers of the NDC will contest against the likes of Bola Tinubu, the incumbent president and presidential candidate of the All Progressive Congress, APC and Atiku Abubakar of the African Democratic Congress.
Earlier this year, Kwankwaso agreed to become the running mate to Peter Obi and both leaders have since merged the support groups, the Obidient Movement and the Kwankwasiyya to wrestle power from the APC government.
Speaking on Channels, he said, “Our supporters are not just merely people who are looking for money or who are looking for textile or food items on the day of election.
“These are people who are determined not only to vote but to make sure that the votes are being protected.”

2027: “You’re afraid because by 12 noon you’ll be defeated’ – ADC tells Tinubu govt over Malami
The African Democratic Congress, ADC, in Kebbi State has accused the Federal Government, led by President Bola Tinubu, of allegedly targeting former Attorney General of the Federation and Minister of Justice, Abubakar Malami, in an attempt to dissuade him from pursuing his governorship ambition in the state.
The allegation was contained in a statement released on Sunday and co-signed by the Kebbi State Chairman of the party, Sufiyanu Bala, and Alhaji Shehu Aliyu Sambawa.
The ADC contended that the federal government is employing judicial measures to intimidate opposition figures at both the federal and state levels.
The party asserted that these alleged actions are designed to instil fear among opposition politicians and deter them from pursuing their political ambitions ahead of the 2027 general elections.
“By 12 noon in 2027, their party is gone. That is why they are intimidating strong opposition figures who appear poised to replace them, particularly Malami, who is being persecuted through the judiciary,” the statement read.
Additionally, the party claimed that the Kebbi State Government is participating in efforts to undermine Malami’s governorship ambition through various intimidation tactics, insisting that nothing will hinder his candidacy in the 2027 election.
The ADC also alleged that the confiscation of Malami’s assets is part of a coordinated strategy by both the Federal Government and the Kebbi State Government to intimidate the former minister.
Despite what it described as judicial and political persecution, the party expressed its determination and confidence that the judiciary would reverse the recent ruling against Malami.
